Terms of Engagement

Version 1.0 · effective 13 October 2026. These terms apply when a healthcare establishment buys any package of the Hospital Legal Compliance Kit from Vivekanand Law Firm.

1. Parties

The engagement is between Vivekanand Law Firm, through Advocate Vivekanand, Raghunathpur, Gandak Colony Road, Motihari, East Champaran, Bihar 845401 (“the Firm”), and the healthcare establishment named at checkout, acting through the person who pays (“the Client”). The person paying confirms that they are authorised to engage the Firm for the establishment.

2. Formation and conflict check

Payment is an offer to engage the Firm on these terms. The engagement begins when the Firm confirms it in writing after checking for any conflict of interest, normally within one working day of receiving the Client's details. If the Firm cannot act for the Client, it says so and refunds the full fee.

5. Fees and payment

Fees are the Firm's professional fees, payable in advance through Razorpay. The Firm does not add GST to its fees; where GST applies to legal services supplied to a business entity, the recipient pays it under reverse charge. Government fees, penalties and third-party charges are payable by the Client directly. No fee depends on the outcome of any matter.

6. The Client's part

  • Give accurate particulars of the establishment and its services, and the documents the package calls for.
  • Not send any patient's name, records or clinical information to the Firm through the website, checkout, WhatsApp or email, unless the Firm asks for a specific document in connection with separately engaged work.
  • Adopt, adapt and implement the documents through its own management, and have procedure-specific clinical consents prepared by its treating doctors.
  • Tell the Firm promptly of any notice, inspection or claim on which it wants advice.

7. Nature of the deliverables

The kit organises the Client's compliance and provides templates and trackers prepared by the Firm with the law stated as on the edition date. It does not by itself make the establishment compliant and does not guarantee any registration, licence, inspection result or legal outcome. Items marked as pending verification are not advice that the requirement does or does not apply. Advice on a particular situation is given only in a consultation or in writing under the engagement.

8. Consultations

Consultations are by phone or video at times agreed with the Firm, within the period stated for the package. Unused consultation time lapses at the end of that period and is not refunded.

9. Licence to use

The Client may use, copy and adapt the deliverables for its own establishment (and, under a Group engagement, for the facilities named in it). The Client may not resell, publish or distribute them to others. The Firm keeps the copyright in its templates.

10. Confidentiality

The Firm keeps the Client's information confidential, subject to its professional duties and the law.

11. Limitation

The Firm's liability arising from an engagement under these terms is limited to the fee paid for it, except where the law does not permit such a limit.

12. Ending the engagement

The Client may cancel as set out in the Refund and Cancellation Policy. The Firm may end the engagement if continuing would breach its professional duties, refunding the fee for work not done.

13. Law and jurisdiction

These terms are governed by the laws of India. Courts at Motihari, East Champaran have jurisdiction.
