What a transfer petition is

A transfer petition asks the Supreme Court to move a case from a court in one state to a court in another, where this is expedient for the ends of justice.

Civil and matrimonial cases

Civil cases, including matrimonial proceedings, may be transferred under Section 25 of the Code of Civil Procedure. In matrimonial cases, the convenience of the parties — particularly the wife and children — is often an important consideration.

Criminal cases

Criminal cases may be transferred by the Supreme Court under the corresponding provision of the BNSS (formerly Section 406 CrPC), usually where a fair trial is shown to be at risk.

Video conferencing as an alternative

Courts increasingly allow appearance by video conferencing, which can reduce the need for transfer in some cases.
