Indian courts can hear the case
When one spouse lives abroad, the spouse in India is not without remedy. Under Section 19 of the Hindu Marriage Act, 1955, a petition may be filed where the marriage was solemnised, where the respondent resides, where the parties last resided together, or where the wife is residing on the date of filing. Maintenance, domestic violence and criminal complaints can also be pursued in India.
When is a foreign divorce valid in India?
A foreign decree is tested under Section 13 of the Code of Civil Procedure, 1908. In Y. Narasimha Rao v. Y. Venkata Lakshmi (1991), the Supreme Court held that a foreign matrimonial judgment will generally be recognised only if it was granted on a ground available under the law under which the parties married, and the other spouse submitted to that court's jurisdiction or contested the case.
A decree obtained abroad without notice, or on a ground unknown to Indian matrimonial law, may therefore be challenged in India.
Remedies a spouse in India may consider
- Petition for maintenance under Section 144 BNSS (formerly Section 125 CrPC)
- Proceedings under the Protection of Women from Domestic Violence Act, 2005
- Criminal complaint for cruelty or dowry under Sections 85 and 86 BNS, where the facts support it
- Representation to the Regional Passport Office, which may act under Section 10(3) of the Passports Act, 1967 where a court case is pending
- Request for a Look Out Circular through the investigating agency in an appropriate criminal case
Service of summons abroad
Summons can be served through the Ministry of External Affairs and Indian missions, and many courts now accept service by email or messaging applications with the court's permission. Proof of service matters: a decree passed without proper service is vulnerable on appeal.
Practical points
- Keep the spouse's foreign address, employer and passport details
- Preserve messages and emails as evidence; record dates
- Do not sign documents sent from abroad without independent advice
- If a foreign court sends papers, take advice before ignoring them — submission to jurisdiction has consequences
Frequently asked questions
Can my husband abroad divorce me without my consent?
He may obtain a decree from a foreign court, but its validity in India depends on the tests in Section 13 CPC and the Narasimha Rao judgment. A decree obtained without your participation, on a ground unknown to the law of your marriage, may not be recognised in India.
Can the NRI spouse appear by video?
Courts increasingly permit appearance by video conference for spouses abroad, particularly in mutual consent and settlement proceedings. It is at the court's discretion.
