Why compliance matters for hospitals
Private hospitals, nursing homes, clinics and diagnostic centres are regulated by several laws. Gaps in registration or records can lead to penalties, closure orders and difficulties when defending complaints.
Registration and licences
- Registration of the clinical establishment under the applicable law in Bihar
- Fire safety NOC from the competent authority
- Pharmacy licence under the Drugs and Cosmetics Act, 1940, where medicines are dispensed
- Registration under the PCPNDT Act, 1994 for ultrasound and imaging equipment
- Approval under the MTP Act, 1971 where termination of pregnancy is performed
Biomedical waste
The Bio-Medical Waste Management Rules, 2016 require segregation, storage and disposal through authorised facilities, and authorisation from the State Pollution Control Board.
Records and consent
- Informed written consent for procedures, in a language the patient understands
- Complete case sheets, discharge summaries and records
- Form F and other PCPNDT records for imaging centres
- Clear billing and display of charges where required
Staff and workplace
- Appointment letters and contracts for doctors and staff
- Verification of qualifications and registrations
- POSH Act policy and Internal Committee
- PF, ESI and labour compliance as applicable
Complaints and negligence claims
Hospitals may face consumer complaints, civil suits or criminal complaints alleging negligence. Good documentation is the strongest defence. See our guide on medical negligence for the legal position.
